This Privacy Policy does not apply to any other website or digital service that you may be able to access through FYW’s Services or any website or digital services of FYW Advisors, vendors, or partners, each of which may have data collection, storage, use, and disclosure practices and policies that may materially differ from this Privacy Policy. If you are a Member, you acknowledge that we may collect this Personal Information from you directly and/or from your WHEN Advisor(s). We may ask you and/or your WHEN Advisor(s) to provide Personal Information about you that will enable us to enhance our ability to serve your needs and/or your use of WHEN’s Products and Services. It is entirely your choice whether or not to provide Personal Information through WHEN’s Products and Services. If you choose not to provide requested Personal Information, you may not be able to use certain features of WHEN’s Products and Services.

 

03. Protected Health Information

As used in this Privacy Policy, “Protected Health Information” means Personal Information in conjunction with information related to physical or mental health, such as medical history, family history, medical diagnosis, health background, current health status, age, gender, sexual behavior and sexual orientation, demographic information (including race, ethnicity, marital status, salary, education, political, religious, and trade union information) and information related to the diagnosis and treatment of health conditions, over-the-counter and prescription medications, health supplements, laboratory test results, payments for treatment and health insurance information, or other personally identifiable information under an applicable law such as HIPAA governing the use or disclosure of Protected Health Information (or as States may otherwise define Protected Health Information). We may ask you or your WHEN Advisor(s) to provide Protected Health Information about you that will enable us to enhance our ability to serve your needs and/or your use of WHEN’s Products and Services. When you use WHEN’s Products and Services, we may collect, use or disclose Protected Health Information consistent with this Privacy Policy and our Terms of Use https://member.findyourwhen.com/legal/index.html. It is entirely your choice whether or not to provide Protected Health Information to or through WHEN’s Products and Services. If you choose not to provide requested Protected Health Information, you may not be able to use certain features of WHEN’s Products and Services.

 

04. Information Collection & Use

Company collects Personal Information from you through the Services to allow us to provide the Services that will most likely meet your needs and preferences.  We only collect Personal Information about you that we consider necessary for achieving this purpose.

In general, you can browse Company and “opt-out” from providing us with any Personal Information.  Once you agree to provide us with Personal Information, you are no longer anonymous to us. If you choose to use and/or purchase certain Services we may require you to provide contact and identity information, billing information, and other Personal Information as indicated on the applicable forms. Upon your enrollment as a Member, we may collect a membership fee or other charges via credit card payment for your access to and use of FYW Products and Services. In connection with your payment of this fee or other charges, we capture certain credit card information and other personal information related to your payment, including (“Payment Data“). It is entirely your choice whether or not to provide Payment Information to or through FYW Products and Services. If you choose not to provide requested Payment Information, you may not be able to use certain Products and Services.

Under some circumstances we may require some additional financial information. We use your financial information, including credit card information, to verify the accuracy of your name, address and other information, as well as to bill you for your use of our services and products.

 

06. Use of Your Personal Information

We use your Personal Information, and other information we obtain from your current and past activities using the Services to: present our Site and its contents to you; resolve disputes; troubleshoot problems; measure consumer interest in our products and services; inform you about online and offline offers, products, services, and updates; customize your experience on Company; detect and protect us against error, fraud and other criminal activity; to provide you with notices about your subscription, including expiration and renewal notices; To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection; enforce our Terms of Use; and as otherwise described to you at the time of collection. 07. Communications from Company

We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if access to our products is temporarily suspended for maintenance, we might send you an email or text message. 09. Information Sharing and Disclosure

As a matter of policy, we do not sell, rent, or share any of your Personal Information, including your email address, to third parties for their marketing purposes without your explicit consent. However, the following describes some of the ways that your Personal Information may be disclosed in the normal scope of business to provide our services and products to customers:

  • Purpose: We may disclose your Personal Information to fulfill the purpose for which you provide it.
  • Buyers or Successors: To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of When Enterprises Corporations’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by Company about our Site users is among the assets transferred.
  • Legal Requests: Company cooperates with law enforcement inquiries, as well as other third parties to enforce laws, such as: intellectual property rights, fraud and other rights, to help protect you, other users, and Company from bad actors. Therefore, in response to a verified request by law enforcement or other government officials relating to a criminal investigation or alleged illegal activity, we can (and you authorize us to) disclose your name, city, state, telephone number, email address, username history, and fraud complaints without a subpoena. Due to the existing regulatory environment, we cannot ensure that all of your private communications and other Personal Information will never be disclosed in ways not otherwise described in this Privacy Policy. We cannot delete your personal information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Nonetheless, WHEN is committed to protecting your Personal Health Information. In the event WHEN’s status changes such that it is subject to HIPAA, we intend to update our Privacy Policy and Terms of Use.

You may manage how your browser handles cookies and related technologies by adjusting its privacy and security settings. Browsers are different, so refer to instructions related to your browser to learn about cookie-related and other privacy and security settings that may be available. 14. Children Under the Age of 13  

We do not knowingly collect information from minors. Our Site is intended for and directed towards adults. Our Services are not directed to minors and we do not knowingly collect Personal Information from minors.  Our Site is not intended for children under 13 years of age. No one under age 13 may provide any personal information on the Site. We do not knowingly collect personal information from children under 13.
